Overview: JetFuel, Inc (maker of "The Plug" app) is sponsoring a contest to reward the top seller during the contest period (the “Contest”) and is simultaneously sponsoring a Sweepstakes Game (the “Game”).
The Contest
a. CONTEST PERIOD: The Contest begins on November 27th, 2019 12:00 pm Pacific Time (PT) Zone in the United States and ends on January 6th 2020, 12pm pm Pacific Time (PT) Zone ("Contest Period"). All dates are subject to change.
b. ELIGIBLE PARTICIPANTS. Except as set forth below, all Influencers aged 18 or older and residing in the Eligible Territory are eligible to join the Contest, except for residents of Quebec, who are ineligible to participate in the Contest. Any entrant who misrepresents his or her state or province of residence is ineligible to enter or win the Contest, and any such misrepresentation will result in immediate disqualification from the Contest.
Persons in any of the following categories are NOT eligible to participate in or win prizes in the Contest: any person who on or after October 1, 2019, was or is: (a) a director, officer, employee, agent of JetFuel, or any affiliate of JetFuel, or any entities retained by JetFuel for the administration of the Contest; (b) an immediate family member (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who resides in the same household as, any person in any of the preceding categories.
c. ELIGIBLE TERRITORY. The Contest is active in all of the United States and Canada, except the Contest is void in the Canadian Province of Quebec.
d. BINDING AGREEMENT: In order to participate in the Contest, you must agree to the Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that entering the Contest constitutes agreement to these Rules. You may enter the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and JetFuel with respect to the Contest.
e. WINNING THE CONTEST. The winner of the Contest shall be the Influencer who earns the most plugcoin from JetFuel’s The Plug app during the Contest Period. Coins are awarded to influencers on a CPI basis for driving app installs or clicks to our various partners. Coins are eligible if they are earned during the contest timeframe and not earned by following all the guidelines of The Plug. Any coins earned with any sort of incentivization of the users will not be eligible and will render the user non eligible for the Game or Contest.. JetFuel shall be solely responsible for determining the winner of the Contest based on these rules, and its determination is final and binding on all Contest participants.
f. CONTEST PRIZES:
i. The 1st place winner will win a Tesla Model 3. Alternatively the winner may choose a cash prize of $40,000.
ii. 2nd Place will win a Used 3000lb Industrial Fork Lift. Alternatively the winner may choose a cash prize of $10,000.
iii. 3rd – 5th Place will win a New Macbook Pro. Alternatively the winner may choose a cash prize of $3,000.
3. The Game
a. GAME PERIOD. The Game begins on November 27th, 2019 12:00 pm Pacific Time (PT) Zone in the United States The deadline for entries for the Game is on January 6th 2020, 12pm pm Pacific Time pm Pacific Time (PT) Zone (the "Game Period"). All dates are subject to change.
b. ELIGIBILITY: The Game is only open to Influencers in the The Plug influencer network aged 18 years and older. Persons in any of the following categories are NOT eligible to participate in or win prizes in the Game: any person who on or after October 1, 2019, was or is: (a) a director, officer, employee, agent of JetFuel, or any affiliate of JetFuel, or any entities retained by JetFuel for the administration of the Game; (b) an immediate family member (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who resides in the same household as, any person in any of the preceding categories.
Residents Quebec are ineligible to participate in the Game. All entrants must be a legal resident of the United States or Canada to be eligible. Any entrant who misrepresents his or her state or province of residence is ineligible to enter or win the Game, and any such misrepresentation will result in immediate disqualification from the Game.
c. ELIGIBLE TERRITORY: The Game is active in all of the United States and Canada except the Game is void in the Canadian Province of Quebec.
d. HOW TO PARTICIPATE: For every $0.50 (10 plugcoins) earned in commissions through the The Plug Influencer network] during the Game Period, JetFuel will grant you one unique entry in the Game. On the 2st day after the completion of the Game Period, one entry will be drawn randomly for each prize from all of the entries entered in the Game during the Game Period. The holder of this one number drawn will be the winner of the prize for which a winner is being drawn. The winners will be notified of the result via the email address provided when entering the Game. Winners must provide valid Government-Issued Photo Identification to verify the winners’ identity. Once a particular prize winner’s identity and eligibility are verified, that winner will be awarded the applicable prize.
Upon timely entry, your assigned Prize number(s) will be fully eligible to win. If you are eligible for multiple entries, multiple Prize Numbers will be assigned to you. By participating in the Game, each entrant unconditionally accepts and agrees to comply with and abide by these Rules and the decisions JetFuel makes in respect to these Rules which shall be final and binding in all respects. The drawing will occur on January 7th, 2020 at which point the winners will be announced.
e. HOW TO ENTER THE GAME WITHOUT A PURCHASE (AMOE): Individuals can enter the Game by mailing a handwritten letter containing your first and last name, age, mailing address including city and zip code, and email address. The handwritten letter must request an entry in the Game and you must include a self-addressed stamped envelope (for Residents of Vermont, this is not required). Once receiving this, JetFuel will return to you your entry number in the self-addressed stamped envelope you provided. Contestants are limited to one free entry per day. Each entry must be mailed separately and postmarked on separate days. Typewritten letters are not accepted. Residents of Vermont may omit the return postage. f. PRIZES: The prizes in the Game are as follows:
i. One STX 160 Jet Ski will be raffled off. Alternatively the winner may choose a cash prize of $10,000.
ii. Three iPhone 11 Pro’s will be raffled off. Alternatively the winner may choose a cash prize of $1,100.
iii. Five Apple Watch Series 3’s will be raffled off. Alternatively the winner may choose a cash prize of $500.
iv. 10 Apple Airpod Pros will be raffled off. Alternatively the winner may choose a cash prize of $250.
v. 20 Amazon $50 Gift Cards will be raffled off. Alternatively the winner may choose a cash prize of $50.
vi. 1 Sonos Smart speaker will be awarded to the user who referrers the highest earning new influencers. Alternatively the winner may choose a cash prize of $600.
vii. 1 60” Flat Screen TV will be awarded to the user who submits the higest performing ad set. Alternatively the winner may choose a cash prize of $600.
JetFuel reserves the right to include additional prizes of lesser value, which may or may not include the opportunity to select a cash alternative.
g. ODDS OF WINNING: Odds of winning are based upon the total number of entries allotted to eligible entrants in accordance with these Rules.
h. ALL ENTRIES HAVE THE SAME CHANCE OF WINNING. If you enter the Game, your entry will have the same chance to win as every other entry. The Prizes are Guaranteed to be Awarded as Offered. No Purchase Necessary to Enter. Making a Purchase Will Not Increase Your Odds of Winning.
- TAXES: IN ORDER TO RECEIVE THE PRIZE, THE WINNER MUST SUBMIT TO JETFUEL ALL DOCUMENTATION REQUESTED BY JETFUEL TO PERMIT IT TO COMPLY WITH ALL APPLICABLE STATE, FEDERAL AND LOCAL TAX REPORTING. IF THE WINNER ELECTS THE CASH PRIZE, THE CASH PRIZE WILL BE PAID NET OF ANY TAXES THAT JETFUEL IS REQUIRED BY LAW TO WITHHOLD. TO THE EXTENT PERMITTED BY LAW, ALL TAXES IMPOSED ON THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.
If the winner fails to provide such documentation, the prize may be forfeited and JetFuel may, in its sole discretion, award the prize to the runner-up.
GENERAL CONDITIONS: All federal, state and local laws and regulations apply. JetFuel reserves the right to disqualify any entrant from the Contest if, in JetFuel’s sole discretion, it believes that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, or JetFuel or its employees, officers or directors.
PUBLICITY: By entering the Contest, entrants agree to participate in any media or promotional activity resulting from the Contest as reasonably requested by JetFuel at JetFuel's expense and agree and consent to use of their name and/or likeness by JetFuel. JetFuel will contact entrants in advance of any such media or promotional activities.
Limits of Liability, Force Majeure, Miscellaneous Terms: By entering the Contest or the Game, each entrant accepts and agrees to be bound by these Rules. JetFuel and its affiliates are not responsible for any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest or the Game or by any technical or human error which may occur in the operation of the Contest or the Game. JetFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. JetFuel is not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating in the Contest or the Game. If, for any reason, either the Contest and/or the Game is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of JetFuel which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest or the Game, JetFuel reserves the right to modify, suspend or terminate the Contest or the Game.
INDEMNIFICATION. To the maximum extent permitted by law, entrant indemnifies and agrees to keep indemnified JetFuel at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, entrant agrees to defend, indemnify and hold harmless JetFuel from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from: (i) any misrepresentation made by entrant in connection with the Contest; (ii) any non-compliance by entrant with these Rules; (iii) claims brought by persons or entities other than the parties to these Rules arising from or related to entrant's involvement with the Contest; (iv) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in the Contest; or (v) any typographical or other error in the printing, offering or announcement of any prize or winners in relation to the entry and participation in the Contest by entrant.
ELIMINATION: Any false information provided within the context of the Contest by entrant concerning identity, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the like may result in the immediate elimination of the entrant from the Contest.
DISCLAIMER: JetFuel's failure to enforce any term of these Rules will not constitute a waiver of that or any other provision. JetFuel reserves the right to disqualify entrants who violate the rules or interfere with the Contest or the Game in any manner. If an entrant is disqualified, JetFuel reserves the right to terminate that entrant's eligibility to participate in the Contest or the Game.
FORUM AND RECOURSE TO JUDICIAL PROCEDURES: These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest or this Game are hereby excluded, and entrants expressly waive any and all such rights.
ARBITRATION: By entering the Contest or the Game, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Contest or the Game will be decided by binding arbitration. All disputes between you and JetFuel of whatsoever kind or nature arising out of these Rules, shall be submitted to Judicial Arbitration and Mediation Services, Inc. ("JAMS") for binding arbitration under its rules then in effect in the San Francisco, California, USA area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
NOTIFICATION OF WINNERS. The winner of the Contest and the winners of the Game will be notified through The Plug app, and if necessary email associated with the winner’s entry on or before Januray 9th, 2020. If the winners do not respond to the notification attempt within thirty (30) days from the notification attempt, then such winners may be disqualified. If the Contest winner does not so respond, JetFuel shall name the runner-up as the winner. If one or more of the Game winners do not so respond, then JetFuel shall have another drawing or drawings for a new winner or winners of the prize or prizes in question. Except where prohibited by law, the winners may be required to sign and return an Affidavit of Eligibility and Liability and Publicity Release and provide any additional information that may be required by JetFuel. If so required, the winners must return all such required documents via fax (or as otherwise instructed) within forty-eight (48) hours and via U.S. Mail within seven (7) days following attempted notification or the non-compliant winner will be deemed to have forfeited the prize and JetFuel will use the above described process to determine a new winner or winners, as applicable. All notification requirements, as well as other requirements within these Rules, will be strictly enforced.
